Woman gets $3,500 fine and bad credit score for writing negative review of business

In 2009, Jen Palmer’s husband bought her some Christmas gifts from KlearGear.com. When the merchandise still hadn’t arrived a month later, PayPal closed the transaction and refunded her money.

Palmer tried to contact the company to inquire about the order, but couldn't get in touch with anyone. Frustrated, she wrote a critical review of the company on RipoffReport.com and moved on.

But as KUTV reports, KlearGear.com resurfaced three years later and has turned Palmer’s life upside down, slapping her with a $3,500 fine and reporting her to the nation’s three major credit agencies.

"This is fraud," Palmer told the station. "They're blackmailing us for telling the truth."

Here’s what happened. Tucked away in the agreement language almost no one ever reads, was a clause stating that anyone who buys something from the website agrees to never publicly criticize the website.

The exact language reads:

"In an effort to ensure fair and honest public feedback, and to prevent the publishing of libelous content in any form, your acceptance of this sales contract prohibits you from taking any action that negatively impacts kleargear.com, its reputation, products, services, management or employees."

However, on some review sites individuals claim that the clause only went into effect in 2013, meaning that Palmer should be exempt from the fine policy. Interestingly, review sites also contain a number of mixed to negative customer reviews but only this one mention of the company actually issuing a fine to a customer.

And the actual language from the clause has since been removed from Kleargear's website.

In fact, the company may be facing some heat for bragging about it's own reviews. The Better Business Bureau has issued an alert against KlearGear saying the company has falsely claimed to have received an A+ rating from the BBB. "As of November 28, 2012, the BBB became aware that the company's website is displaying a BBB Accredited Business logo and BBB Rating A+," reads a statement on the BBB website. "However, the company is not an accredited BBB business and the BBB rating is not A+."

Still, someone from the company contacted Palmer’s husband via email and told him he had 72 hours to remove her critical review from the site Ripoff Report, or face the $3,500 fine. Her review read in part, "There is absolutely no way to get in touch with a physical human being" at the site, adding that they have, "horrible customer service practices."

Nonetheless, Jen Palmer actually contacted Ripoff Report but that site demands $2,000 to remove a post.

Naturally, Palmer refused to pay the fee. Then, she found out that not only had Klear Gear imposed its arbitrary fine, but they had reported the “failure to pay” status to the major credit bureaus.

And the credit bureaus haven’t been helpful either, refusing to remove the mark from her husband's credit score. Jen Palmer says that she and her husband are now receiving rejection letters from lenders as a result of the negative mark on their credit score.

So, the Palme'rs now find themselves at the mercy of three unresponsive entities: the website that fined them for exercising their First Amendment rights, the review site that refuses to remove her post and the credit bureaus, which are taking the side of the website over a customer who may be the victim of corporate fraud. In the meantime, KUTV has put the Palmer's in contact with a media relations representative at Experian, in an attempt to resolve the situation.

"I have the right to tell somebody else these guys ripped me off," Palmer said.

Get Out!

Leave the USA! The time has come for all True Believers to get out of Babylon. The United States is Babylon. The judgment has been decreed and is being delayed only until the number of True Believers who choose to leave has been fulfilled. As soon as they are gone, the judgment will fall. The judgment may not fall this week, this month, this year or it may be delayed 200 years, but God is not giving us the option to delay our departure. If you are going, move now! God knows there will be some who choose to remain behind. For those who make such a choice, God will be with you to the end, but you should expect to die.

Take whatever you can, sell everything else, convert it to cash. Use this cash to establish yourself in a new place. Almost any country is good, with some common sense exceptions; southern Europe, the Mideast, North Korea, Iran, Afghanistan and Pakistan, Somalia, etc. If there is any country or place you wanted to visit or move to, now is the time.

Do not count on the US government to continue your Social Security, Medicare, welfare, government pensions or any entitlement program. These all may disappear.

The Rapture is due at the Last Trumpet which comes after the Tribulation. God is calling you now to receive His Protection, otherwise you will share in the judgment that has been decreed for Babylon.

There are some whom God is caling home now. These are mostly children and the elderly. God wishes to spare them the horrors of the judgment, therefore they are being called home now. Do not count on being called home, you are being called to get out.

Remember that wherever you go, Jesus will be there with you and when you arrive He will show you what to do next.

Free Trial Tips

Are you concerned about your credit card information when using it to sign up a free trial offer, worried about being billed thereafter if you forget to cancel at the end? Here I will share with you several useful tips and pitfalls from my personal experience with free trial offers.

Many of the free trial offers do give tremendous value to consumers for free. One example is Blockbuster Total Access 2 weeks' free trials. You can rent 15 to 20 DVDs for free with both the online mailing and in-store exchange. The other example is Yahoo music 14 days free trial. You can listen unlimited songs from 2 million collections using its program during the trial period. Similar valuable offers are provided in many other categories, such as stock trading, real estate, online library, communication tool, sports content, online video, game, online dating, etc. You can most likely find a free trial offer online for any service or product that you like.

Here are the few tips that would help you to find and sign up for free trial offers:

1. Use Google to search for free trials by keywords of "Free [category] trial offers"

2. If you are suspicious about the business that offers the trial, use "contact us" in the business website to call the customer service. If you reach voice mail during business hour, generally it is a small company and it might not be safe to give out credit card or other sensitive information.

3. Create a separate email for trial to avoid spam

4. Search the FAQ in the website for cancellation process. Most of the companies have a FAQ for how to cancel the subscription.

5. For online cancellation, most common route is to login to the website, go to "my account", find the link like "cancel my subscription." and follow the steps.

6. Get Credit Monitoring service (e.g. Identity Guard) if you are signing up free trial offers frequently and are concerned about identity fraud.
